A pivotal development has positioned the International Court of Justice (ICJ) to announce its decision on the Israel-Gaza Case. The court will determine whether to order emergency measures against Israel in response to South Africa’s genocide allegations over its assault on Gaza. On Wednesday, the United Nations’ top court announced that a 17-judge panel will respond to South Africa’s requests on January 26 at 12:00 GMT.
The court expects South Africa’s Foreign Minister Naledi Pandor to be present at The Hague as it reveals its decision. The ICJ clarified that the focus on Friday will not be on determining whether Israel is committing genocide. But on examining the emergency measures proposed by South Africa to restrain Israel’s actions.
“Earlier this month, in Israel-Gaza hearings, South Africa pressed the ICJ for an emergency suspension of Israel’s Gaza military campaign. S.A mentioned the need for provisional measures to protect the rights of the Palestinian people under the Genocide Convention.
The South Africa filed Nine Injunctions. It included demands for an order directing Israel to halt all military operations in Gaza. The other directing Israel to facilitate the delivery of humanitarian aid into the region.
Legal experts anticipate a thorough deliberation by the ICJ. This includes detailed written submissions, oral arguments, and counter-arguments about the Israel-Gaza Case. “If granted, the court would issue a legally binding ruling. But it could take three to four years to reach a final decision on the genocide allegations.
While some experts suggest that the court may not go as far as suspending military activities, they consider the likelihood of instructing Israel to ensure compliance with international law during military operations and facilitating unhindered humanitarian aid delivery.
Israel has vehemently dismissed the genocide allegations as “grossly distorted”. It also emphasized its right to defend itself against Hamas, the Palestinian group that initiated an attack on October 7. The Israeli military campaign has resulted in significant casualties, with over 25,700 people killed, according to Palestinian authorities in Gaza. The victims are mostly women and children
The ICJ’s decision on emergency measures, holds significant implications for Israel’s international standing, with any order to halt operations posing a major challenge. The United States has been a key supporter and weapons supplier to Israel. it has continued to back the country amidst the ongoing controversy.
